How We Can Help You With Debt Recovery?

Andrew Byrnes Law Group’s experienced team assists sole traders and SMEs to large corporations. We will advise you on the most efficient ways to recover both disputed and undisputed debts owed to you, whether it be by way of negotiation, letter of demand, or commencing court proceedings.

The point of difference between us and a debt collection service is that we not only chase the debt for you by issuing a letter of demand but also, we can go to court, taking care of the entire debt recovery process, from demand to enforcement.

Andrew Byrnes Law Group has extensive experience in providing legal advice and services concerning debt recovery, including but not limited to;

  • Reviewing your standard contracts to improve the terms and conditions and thus safeguarding your business and you
  • Representing clients in informal discussions and mediation conferences with debtors and/or creditors
  • Preparing letters of demand and issuing them
  • Obtaining a judgment against debtors
  • Representing you in proceedings in a tribunal or court in your state or territory
  • Enforcing judgments using instalment orders, garnishee orders, and bankruptcy or corporate insolvency proceedings

Letter of Demand.

Quite often a letter of demand from a debt recovery solicitor is a great option to get debtors to pay off debt and avoid litigation. This shows you are serious about recovering the money owed to you, giving the Debtor a set amount of time to make payment.

If after the letter of demand the debtor has still neither paid the debt that is due nor negotiated a repayment plan (or responded at all), then the next option would be commence legal proceedings.

If the matter does reach litigation, the court can order judgement against the debtor. The judgement may include legal costs and interest.
